This privacy policy is intended to comply with the 201 CMR 17.00 of the Massachusetts Office of Consumer Affairs And Business Regulation, which is based on Massachusetts General Laws Chapter 93H and any applicable United States federal law.

This Privacy Policy applies to KP & CS Enterprises, Inc. (dba “Storm Scooters”), a Massachusetts corporation located at 322 Commercial Street, Provincetown, MA 02657.

Please be aware that companies not part of Joyride Technologies, a Canadian company located at 325 Front St W, Toronto, ON M5V 2Y1, Canada, are separate legal entities from Joyride Technologies and have their own privacy policies and practices. While we encourage you to review those third-party policies, please understand that Joyride Technologies is not responsible for those companies’ privacy policies and related legal obligations, including those of Storm Scooters.

Our business takes your privacy seriously and is committed to safeguarding your privacy online. Because we do gather certain types of information from visitors to our sites, we have developed a privacy statement to help you understand the terms and conditions surrounding the collection and use of that information. This statement discloses the types of information we gather, how it is used, and how you can gain access to and edit any data that we've collected about you at any time.

GUIDING PRINCIPLES

Our business respects the privacy of individuals who visit our website, send us email, or participate in features/services we offer online. Accordingly, our policy regarding online privacy has been developed using the following guiding principles:

Our business maintains a strict "no-spam" policy. Subscribers to our email services (or any other feature/service found on our website) will not receive unsolicited email messages from us.

Our business collects information online primarily to provide our visitors with a more relevant experience on our site. When doing so, we will make every reasonable effort to avoid excessive or irrelevant collection of data.

Our business will take reasonable physical, electronic and managerial measures to safeguard and secure any information you provide to us (e.g. data will be stored in protected databases on secured servers with restricted access).

Our business will not share any information you've provided to us with anyone without your consent other than to provide the service you've requested. At the time you register for any such service, you will be notified of, and asked to consent to, the sharing of your information with any particular third party necessary to the provision of the requested service.

CONTACT INFORMATION

Before you take a ride on a Joyride Technologies or Storm Scooters rental vehicle, participate in our surveys, contests, sweepstakes, and promotions, subscribe to our marketing updates, use our customer service, register for, or attend, an event, or when you register a vehicle you purchased directly from us, you will be asked to provide certain basic personal contact information such as first name, last name, email address, and a mailing or postal address, phone number, and account information such as login and password. This information may also be provided to us by another person who organizes a group ride that includes you.

GOVERNMENT-ISSUED IDENTIFICATION

In many places where we offer vehicles for rent, rules require riders to be of a certain minimum age. To hire or employ you, we may be required to confirm your identity and eligibility for employment. We may ask you to provide your birth date and driver’s license or other government-issued ID (which may indicate document numbers as well as birth date, gender, and photo).

BIOMETRIC DATA

In many places where we offer vehicles for rent, rules require riders to be of a certain minimum age. We may use self-taken photographs or videos to determine if you meet any applicable minimum age requirement and we share it only with third parties as necessary to confirm the foregoing. We may also use biometric information, such as photographs, videos, or body mass to confirm that only one rider is utilizing our service.

DEMOGRAPHIC DATA

We also collect certain demographic data if you provide it to us including age, gender, preferred language, and current location. Note that we may also derive this data from your government-issued ID.

PAYMENT INFORMATION

If you buy a product directly from us or rent a Joyride Technologies or Storm Scooters rental vehicle we will also ask for your payment information, such as a credit card, debit card, or another payment method, and your billing address. We do not store your payment information; we use experienced and trusted third-party payment processors to collect and process your payments for us. We also ask for your Tax Identification Number in jurisdictions that require us to collect this information.

LOCATION AND VEHICLE USAGE

When you buy or rent directly from us a Joyride Technologies or Storm Scooters vehicle using our app, or visit our website, or connect your privately owned vehicle to our app, we automatically collect and store location information from your device and from the vehicle you use:

Devices: We collect the location information (e.g., city, state, or postal code where available) associated with the IP address of the device you use to access the services, as well as, with your permission, your mobile device’s location information using GPS or Bluetooth (you can change your location/Bluetooth settings for your mobile device; however, certain features may not be available through the mobile application if you do so).

Vehicles: We collect the latitude and longitude of your vehicle in real-time. This information can be used to determine your device or vehicle’s current location, travel direction, and speed.

USE OF PERSONAL INFORMATION

We may, but are not limited to, using your personal information to provide, maintain, and improve our services, such as to:

-Establish and maintain your account

-Sell, rent and/or deliver a vehicle to you that you have purchased or rented from us

-Confirm your identity

-Verify your eligibility to buy or rent a vehicle from us

-Troubleshoot and resolve your questions or concerns

-Provide and operate our websites, mobile apps, and related features

-Track our vehicles’ location and availability

-Monitor vehicle health and statuses

-Process payments you make to us

-Provide services to you

-Comply with our agreements with you

-Manage and protect our networks, services, employees, and users

-Detect, investigate, take action regarding, and prevent illegal activities, misuse, suspected fraud, or situations involving potential threats to the safety or legal rights of any person or entity

-Comply with the law and fulfill lawful requests for information

-Permit you to update, edit, and manage your content

-Conduct research and perform data analyses to better understand our customers and how our vehicles, products, services, websites, and mobile apps are used

-Create pseudonymous, anonymous, and aggregate information about our customers’ use of our vehicles, products, services, websites, and mobile apps

-Use as evidence in litigation

-Investigate, enforce, and prevent violations of our policies and terms (including this Privacy Policy, our Terms of Use, and Rental Agreement)

-Establish, protect and defend our legal rights

-Confirm your identity

-Verify eligibility of job applicants

PUBLIC PARTNERS AND TRANSPORTATION AUTHORITIES

Because our services will fall under various local, state or federal jurisdictions, our business partners may include governmental and quasi-governmental authorities and local public transport operators and appointed data aggregators (each a “public partner”).

We will disclose your information with public partners as may be required to operate in a particular city or location. Public partners may use this information to help improve, inform, or manage city planning activities, public transportation services, traffic congestion, or our vehicles or services (for example, for designating vehicle parking zones, issuing parking fines, or creating restricted areas where our vehicles may not go, like sidewalks) among other public interest purposes the public partner may determine. In some cases, sharing your information with our public partners may be required by law or regulation.

For some of these purposes, cities have adopted a standard data set called “Mobility Data Specification” (MDS), MDS standardizes communication and data-sharing between cities and private mobility providers such as our business.  We may provide MDS data to public partners where we provide services.

FEEDBACK

If you respond to a survey about your experiences with us or offer opinions about our company, the micro-mobility industry, or other topics, we will maintain that information. Likewise, if you comment on blog entries, interact with us on social media, or participate in other forums operated by Joyride Technologies or Storm Scooters, we collect that information, too. We may collect data when you call (such as a recording of the conversation) or write to us for help or seek other customer support services.

NON-PERSONALLY IDENTIFIABLE DATA

Anytime you visit our website, we may gather certain non-personally identifiable information regarding the means you use to access our website. This information may include the type and version of your browser, your service provider, your IP address and any search engine you may have used to locate the site. We use this information to help diagnose problems with our server, administer the website, and compile broad statistical data. In addition, we gather certain navigational information about where you go on our websites. This information enables us to determine which areas of the websites are most frequently visited and helps us to tailor the sites to the needs and interests of our online visitors. Such information is gathered by us in the aggregate and will not be associated with a specific individual without that individual's consent.

We may create de-identified, aggregated, or anonymized data from your information so that it is reasonably non-identifiable to you. Where we transform data in this way, it is not within the scope of this Privacy Policy.

INFORMATION VOLUNTARILY PROVIDED

Any information you provide to us (i.e. name, email address, etc.) when you enroll in one of our email reminder services, request information, or use any of the other interactive portions of our websites, is securely maintained on our web server and internal systems. This information may be used to provide you with information you've requested about our company, our products and our services, or to provide you with special notices. You may opt out of receiving future communications at any time (see opt-out procedures below). This data may also be used to tailor your experience on our sites by providing content that is relevant to your interests and geographic region.

INFORMATION COLLECTED FROM OTHER SOURCES

To help us better understand and respond to your needs and interests, we may in the future receive information about you from other sources. We will ask any provider of such information to represent and warrant that the information has been gathered and maintained in accordance with all state and federal laws. Any such information will be maintained by us in accordance with the standards set forth in this privacy policy along with other personal information you've provided.

DISCLOSURE OF PERSONAL INFORMATION

Our business understands the importance of your privacy. We collect and maintain the personal information of our consumers for our use and our subsidiaries. We do not sell, rent, or trade consumer information to third parties, other than as described below, and never without your consent. Third parties may collect personally identifiable information about your online activities over time and across different websites when you use this website.

BUSINESS PARTNERS

Our business may partner with select retailers and other companies at various times to provide expanded services to our site visitors. As part of such a relationship, we may share with these companies the use of certain interactive website functions. Information provided by site visitors through the use of such interactive functions may be available to both our business and our partners.

AGENTS

Our business may use other companies and individuals to perform certain functions on our behalf. Examples include administering email services and running special promotions. Such parties only have access to the personal information needed to perform these functions and may not use or store the information for any other purpose. Subscribers or website visitors will never receive unsolicited email messages from agents working on our behalf.

BUSINESS TRANSFERS

In the event that our business sells or transfers a particular portion of its business assets, consumer information may be one of the business assets transferred as part of the transaction. If substantially all of the assets of our business are acquired, consumer information may be transferred as part of the acquisition.

ANALYTICS SOFTWARE

We may use analytics software to help us better understand the user’s experience on our website (e.g. how much time you spend on which pages, which links you choose to click, what you do and don’t like, etc.) and this enables us to improve our website with user feedback. These services use cookies and other technologies to collect data on your behavior and your devices; in particular device IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website. They store this information in a pseudonymized user profile. Neither they nor we will ever use this information to identify individual users or to match it with further data on an individual user.

ACCESSING OUR WEBSITE FROM OUTSIDE OF THE UNITED STATES

If you are visiting our website from a location outside of the U.S., your connection will be through and to servers located in the U.S. Any information you provide during your visit will be processed and maintained on our web server and other internal systems located within the U.S.

EXTERNAL LINKS

Our websites may contain links to other sites. Our business is not responsible for the privacy practices or the content of these third party websites. To help ensure the protection of your privacy, we recommend that you review the privacy policy of any site you visit via a link from our website.

PASSWORDS

The personal data record created through your registration with our website can only be accessed with the unique password associated with that record. To protect the integrity of the information contained in this record, you should not disclose or otherwise reveal your password to third parties.

PUBLIC FORUMS

Our websites may make chat rooms, forums, message boards, and/or news groups available to its users at various times. Please remember that, unless otherwise stated, any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information in these areas.

You may always opt-out of receiving future communications from our business. Our sites allow users to opt-out of receiving such communications at the point where personal information is requested, or through other means as identified.

BROWSER-BASED DO NOT TRACK

Some browsers incorporate a "Do Not Track" (DNT) feature that, when turned on, signals to websites and online services that you do not want to be tracked.  Because there is not yet an accepted standard for how to respond to a DNT signal, we do not currently respond to DNT signals on this website or on websites where we provide advertisements, content, or other services.
